State to renew construction general permit for stormwater discharge, dewatering wastewaters

HARTFORD, CT, Sept. 11, 2008 -- The Connecticut Commissioner of Environmental Protection (DEP) hereby gives notice of a tentative determination to renew without modifications the General Permit for the Discharge of Stormwater and Dewatering Wastewaters from Construction Activities (construction general permit). A general permit contains discharge requirements, best management practices and treatment requirements specific to the discharge category that are designed to protect the waters of the state from pollution. The Commissioner of DEP is authorized to approve or deny such permits pursuant to Section 22a-430b of the Connecticut General Statutes.

The construction general permit was reissued without modification on October 1, 2007 for one year and will expire October 1, 2008 for discharges to surface waters. The renewal of this permit will continue the authorization for current and new registrants to discharge stormwater and dewatering wastewaters to surface waters until April 1, 2010. If the renewal of this permit is not completed by October 1, 2008, current and new registrants are advised that they must continue to operate under the terms and conditions of the construction general permit issued on October 1, 2007 and may be required to submit individual permit applications. Upon renewal of the construction general permit on October 1, 2008, current registrants need not renew their registration under this permit. New construction activities regulated by this permit will need to register prior to the commencement of construction activities.

This public notice and the current permit are available on the DEP website.

Prior to making a final decision, the Commissioner shall consider written comments on the proposed renewal of this general permit from interested persons that are received within 30 days of the date of publication of this notice. Comments should be directed to Christopher Stone, P.E., Department of Environmental Protection, WPED/Bureau of Materials Management and Compliance Assurance, 79 Elm Street, Hartford, CT, 06106-5127.

All comments should be in writing and may be submitted by post, facsimile to (860) 424-4074, or by electronic mail to [email protected]. The Commissioner may hold a public hearing prior to approving or denying this general permit if in the Commissioner's discretion the public interest will be best served thereby, and shall hold a hearing upon receipt of a petition signed by at least twenty-five persons. Notice of any public hearing shall be published at least 30 days prior to the hearing.
