Environmental law expert Joel Johnston, an associate with the firm Hall Estill, weighs in on the recent Supreme Court decision in the case of County of Maui, Hawaii v. Hawaii Wildlife Fund. The ruling found that a CWA permit is required when there is a "functional equivalent" of a direct discharge from a point source into navigable waters -- including discharges that pass through soil or groundwater.
